Description
Following the May 1963 civil rights demonstrations in Birmingham, Alabama, the State of Alabama asked the Supreme Court to prevent the federal government "from deploying troops of the Armed Forces in the State of Alabama to suppress domestic violence unless and until the Legislature of the State of Alabama or the Executive (if the Legislature cannot be convened) makes application for such Armed Forces." When a case falls under the original jurisdiction of the U.S. Supreme Court, the plaintiff must first file a motion requesting the Court hear the case. This is termed a "motion for leave to file original bill of complaint." The State of Alabama filed such a motion asking the Court to hear their case againt the U.S. government. The "Brief in response to motion for leave to file original bill complaint" found here is the U.S. Solicitor General's defense of the government's position. On May 27 the Supreme Court issued its opinion denying the State of Alabama its request to file a complaint against the U.S. for alerting and stationing military personnel in the Birmingham area.
